The infrastructure investment deficit around the world is considerable. Multilateral financial institutions estimate that only in the transportation and communications sectors, such deficit surpasses the level of US $950 billion, of which, one third corresponds to Latin America and the rest is divided among Asia, Eastern Europe, and Africa.

 

In the face of this enormous financial challenge, national governments are constrained to finance these projects solely with public funds, due to budgetary restrictions and their need to invest more resources in social expenditures.   Therefore, one of the most innovative procedures that have emerged in the last decade is the temporary transferal to the private sector of the design, financing, construction, and operation of public infrastructure works. Such transfer is achieved by means of a public-private partnership based on BOT-type contracts (build, operate, transfer).  BOT’s contractual and financial frame, as applied in productive infrastructure, may also be extended to the development and supply of infrastructure and technology to social sectors such as Education, Health and Justice. Furthermore, BOT arrangements are applicable between private enterprises under the concepts of outsourcing, franchising,  leasing, and concessions.

 

The adequate design of public-private-partnership plans, the precise preparation of relevant contracts and their adaptation to national regulatory frameworks,  and the procurement of long term financial backing, are crucial for the success of this type of arrangements.
